Jody R. Krisiloff

Education: Columbia University School of Law, JD 1979; Mount Holyoke College, B.A. summa cum laude 1976; Degrees in Political Science and Spanish Literature.       

Jody has worked in the fields of commercial and class action litigation in state and federal courts for over twenty five years. Prior to becoming a full-time litigator, she was involved in corporate practice, drafting agreements and representing transactional clients. Over the years, she has represented both plaintiffs and defendants in litigation and has worked on a number of high profile cases involving complex securities, antitrust and breach of fiduciary duty issues.  Jody has represented savings and loans subjected to fraudulent conduct by a government securities dealer, has represented persons seeking recovery from investment losses made in hedge funds invested with Bernard L. Madoff Securities Inc., has represented policyholders seeking recovery in class actions involving mutual insurance company conversions and also represented real estate purchasers alleging price fixing by real estate brokers in Kentucky. She has also worked on complex motions in various cases such as IPO Antitrust Litigation, In re Microsoft Litigation, and other actions.

Some of Jody’s reported cases include:

•  In the Matter of Raskin v. Walter Karl, Inc., 129 A.D.2d 642, 514 N.Y.S.2d 120 (Second Dept. 1987 ):  Dispute involving buy out and valuation of minority shareholder interests in privately-held companies under NY Business Corporation Law Section 1118.    

•  Fiala v. MetLife Insurance Company et al., 6 A.D.3d 320, 776 N.Y. S.2d 29 (1st Dept. 2004):  Reversing dismissal of certain claims by MetLife policyholders in class action brought  against  the Company and certain of its officers and directors in connection with MetLife’s demutualization and conversion to a stock corporation.

•In re Avista Securities Litig, 2007 WL 4568933 (E.D. Wash. 2007):  $9.5 million cash settlement to class in action alleging violations of federal securities laws.

•Hyland v. HomeServices of America, Inc. et al., 2008 WL 4858202 (W.D. Kty. 2008):  Certifying class action in case alleging Section 1 Sherman Act price-fixing conspiracy by real estate brokers in Kentucky.

•Leider v. Ralfe et al., 387 F.Supp.2d 283 (S.D.N.Y. 2005), and 2003 WL 22339305 (S.D.N.Y. 2003):  Two opinions in a series of published decisions involving class certification in multi-million antitrust action against DeBeers for alleged Sherman Act and other violations.

•Sullivan v. D.B. Investments , Inc. et al.( District Court for the District of New Jersey, on May 22, 2008, after consolidating  Leider v. Ralfe with other subsequent  filed actions,  entered  a $295 million final judgment and settlement of antitrust class action; and  awarded significant injunctive relief  against De Beers) (D. N.J. 2008):  Final resolution of this matter is still pending.
