Client is the owner of a multimillion dollar historic office building in midtown Manhattan. During the course of renovation, client contracted with a window supplier to provide and install curtain wall windows for $3.8 million. Some windows were defective and/or defectively installed. $785,000 was withheld by the client. After attempting to negotiate a settlement, contractor sued for the $785,000. Prior counsel, with the client’s consent, was prepared to settle the case, but defendant would not abandon its $785,000 claim. We were substituted in and were able to negotiate a settlement where no money was paid to the contractor and the window supplier assigning its rights under its suppliers’ warranties to our client.
Colin E. Kaufman represented the owner in this proceeding for Adam Leitman Bailey, P.C.
