Upon purchasing and moving into a new condominium in Brooklyn, New York, our client was promised a litany of repairs would be made in her unit, based on her punch list, which was signed by her and the Condominium sponsor at the unit closing. The items on the punch list included floor and baseboard repairs, wall cracks and repainting, replacement of various windows which were scratched, water pressure issues, and various additional cosmetic and fixture issues.
The client was offered a settlement by the Sponsor prior to obtaining representation by Adam Leitman Bailey, P.C.. The settlement offered by the Sponsor was for a minimal amount that Sponsor said would cover the client’s floor replacement. There was little else in the agreement. Trust between the Sponsor and our client had long since broken down, and our client knew she needed help to get what she was promised.
Adam Leitman Bailey, P.C. jumped into action by advising our client to obtain three repair quotes for each item on her punch list that Sponsor was required to fix. We walked our client through various apartment inspections by the Sponsor to verify the conditions complained of. We stuck with our client through what amounted to over a year of negotiations with the Sponsor on each of the items our client was entitled to under the punch list.
The final settlement agreement was meticulously negotiated by Adam Leitman Bailey, P.C. and the Sponsor’s counsel, and left nothing off the table. Every single item that our client was promised in her punch list was included in the settlement as items required to be replaced by the Sponsor. In addition, our client received almost double the amount that Sponsor had originally offered her as compensation for the flooring replacement item. We also were able to get our client additional window replacements that were not included in her original punch list.
Finally, almost three years from her closing date, our client is able to enjoy the apartment she always dreamed of.
