At Adam Leitman Bailey, P.C. our housing discrimination team fights against all types of real estate discrimination both for clients being discriminated against and for those who have been wrongfully accused of discrimination. As reflected in many published and unpublished decisions in front of New York state courts including State Supreme, Housing, Civil, and Federal courts, our team has and always will voraciously fight for our clients.

Condominium and cooperative boards in particular have constantly been at the forefront of many discrimination cases where they are either rightfully or wrongfully accused of discriminatory acts. In New York state it is illegal to refuse a candidate acceptance into a cooperative or condominium board based on an individual’s characteristics including, but not limited to race, national origin, or age, amongst others.

Adam Leitman Bailey, P.C. is proud to represent or defend the underdog and litigate against claims of discrimination. We have overcome tremendous odds in court for candidates who have attempted to join a condo or co-op board and have been turned down due to matters of race, nationality, creed, religion, ethnicity, sex, and family status. Equally, we have fought for condominium and cooperative boards who were wrongfully accused of discrimination.

  • Adam Leitman Bailey, P.C. Makes New Law in the Area of Housing Discrimination: Adam Leitman Bailey, P.C. represented a husband and wife who were denied the ability to sell. The lower court found that they could assert a claim of discrimination against the cooperative under New York State law but not under the Federal Law. In the Supreme Court and on appeal, the cooperative argued that neither law applied because only purchasers, and not sellers, were the protected party who had standing to assert the claim.

Achieves Winning Settlement On Behalf Of Coop Sellers In Landmark Housing Discrimination Case: When the Coop failed to approve the sale, despite the purchasers’ ample financial qualifications, the plaintiffs incurred damages because they were forced to find a new purchaser after the financial crisis struck and market conditions deteriorated.  Advocating a novel legal theory on behalf of its clients, Adam Leitman Bailey, P.C. persuaded both trial and appellate courts to apply state and federal housing discrimination laws for the benefit of the sellers of the Coop unit, even though the prospective buyers were the parties denied housing.
  • Adam Leitman Bailey, P.C. Wins Legal Battle for a Holocaust Survivor, Finding Him a New Home: Adam Leitman Bailey, P.C. successfully persevered for two years, representing a disabled Holocaust survivor who was initially turned away by the board of a luxury Midwood building. Our firm fought back, alleging discrimination against the tenant due to his disability. An appeals court reversed the board’s decision, allowing our client to live his life comfortably and with dignity in a new handicap-accessible home.
